Former Employee Charged With Sexually Abusing Underage Girls

In 2025, John Wesley Whiteside pleaded guilty to four misdemeanors and two felonies related to sexually abusing minors at Yellowstone Boys and Girls Ranch. The Yellowstone County sheriff’s department initiated an investigation into the Montana youth residential treatment center when an employee informed them that a female resident had reported allegations of abuse to a therapist. 

Three female teenagers accused Whiteside of making sexual comments, groping them inappropriately, and holding sexualized conversations with many female patients. Whiteside had only worked at the facility for a month when the allegations surfaced. 

What MT Laws Govern Sexual Abuse Cases Involving Residential Treatment Facilities?

§45-5-502 – Sexual assault is defined as subjecting another person to any form of sexual contact against their consent. Consent cannot be given for a victim under 16 years old and a perpetrator who is at least three years older. 

§41-3-201 – Mandated reporters who have reasonable cause to suspect that a minor is experiencing sexual abuse, physical abuse, emotional abuse, or verbal abuse must report the conduct to the Department of Public Health and Human Services. This statute includes teachers, counselors, residential staff members, medical care specialists, and other employees. 

Department of Public Health and Human Services Regulations – All youth care facilities are required to conduct thorough background checks on staff and volunteers. They must also:

  • Implement fingerprinting and registry checks
  • Cooperate with licensing investigations
  • Potentially close for convictions involving sexual abuse, neglect, or placement on offender registries
