A Documented History of Abuse in New York Foster Care

The issues that are rampant in child welfare agencies and foster homes across the state are well-documented. Let’s examine some of the higher-profile cases in New York from the last few years.

Yates County Man Faces Charges After Multiple Accusations of Abuse During Foster Care

In Dundee, NY, Ronald Chilson was charged with sexually abusing children under his care as a foster parent between 2022 and 2024. At the time, Chilson was a therapeutic foster parent.

He took advantage of his authoritative position to abuse and even rape vulnerable children, including a relative.

NYC Foster Parents Forced Young Women Into Sex Trafficking Operation

In 2022, a married couple serving as foster parents was arrested for allegedly forcing young women into prostitution. Sharice Mitchel and Kareem Mitchell were indicted in NYC for sex trafficking and conspiracy in the fourth degree. At least eight women were involved in the sexual abuse, which began in 2018.

Two of the women were placed in Sharice’s home via the foster care network. At the time, Kareem was already a registered sex offender, and Sharice lied on her foster care application, stating that she did not live with him. According to the report, the Mitchells took advantage of vulnerable New York children by offering a safe place to stay, which many adolescents use to keep off the streets and outside of prison

Man Molests Children in Daycare and Foster Care Locations in Multiple Counties

In 2022, New York State Police reported that John Olson had been committing child sexual abuse in various centers throughout Orange and Delaware Counties. He was indicted on seven charges, including predatory sexual assault of a child and first-degree rape.

According to the police, a social worker named Joan Parks was aware of the sexual abuse, but failed to report it to the appropriate entities to protect children. She was due in a New York court in September of 2022.

Allegations had been made about the child abuse of multiple minors, which initiated the investigation into Olson’s actions. Stories of similar childhood sexual abuse are rampant throughout the state, indicating deep issues within states’ foster care system

Who Is Legally Responsible When a Foster Child Is Abused?

While the main perpetrator of the sexual abuse may be the focus of a victim’s thoughts, many parties could be held liable for failing to protect children in foster care.

The Individual Abuser

The person who directly abused you can be sued. This is typically a foster parent, a sibling in the same home, or even an employee in a foster or daycare center. A New York civil claim against an abusive foster parent can be pursued regardless of the status of a criminal procedure.

Social Workers

Foster parents and children receive regular visits from social workers to assess their environments and monitor the children’s well-being. A social worker who fails to report red flags or notice the signs of abuse could be liable for the victim’s legal damages.

State Entities

An agency that places children with foster parents despite past complaints of abuse is likely liable for some of the child’s suffering. You could hold the placement agency accountable for a poor vetting process or a failure to notice foreseeable risks.

Defendant organizations could include the New York Department of Social Services or the Child Placement Agency.

Sexual abuse survivors must consider the statute of limitations for these claims in New York, which governs how long they have to pursue civil lawsuits. Under Section 208, adult survivors who suffered foster care sexual abuse as childrenhave until their 55th birthdays to seek damages from the entities that played a negligent role.
