Compensation for Survivors of Sexual Assault at Timber Ridge Ranch

Rehabilitation centers across Arkansas are supposed to provide care and safety for vulnerable patients. However, many facilities have failed to do so on numerous occasions, allowing patients to become victims of sexual abuse. If you suffered from a Timber Ridge Ranch sexual assault, you can hold the at-fault parties accountable with a civil lawsuit.

Injury Lawyer Team is an experienced law firm that has supported many survivors of sexual abuse, including those in rehabilitation settings. We know what it takes to prove damages, establish liability, and fight for fair compensation.

Lawsuit claims patients at Timber Ridge were subjected to sexual abuse

Sexual Abuse Allegations Against Timber Ridge NeuroRestorative, Saline County Rehabilitation Center

A lawsuit in Saline County was filed against Timber Ridge Ranch due to a history of vulnerable victims being sexually abused. The lawsuit claims that eight former patients were abused by staff members at the facility, and the administration did not take the appropriate actions to protect other victims.

One of the plaintiffs, Luke Hudson, attended the facility in 2002 as an 11-year-old. He claimed the abuse started on the first day. He was harassed, abused, physically tortured, and threatened.

Luke Hudson also stated that he suffered serious consequences because of the abuse, including self-esteem issues, brain injuries, and psychological disorders. Whenever he reported the abuse to facility administrators, he was told he was imagining things or lying.

Hudson and other plaintiffs claimed that the facility’s lack of security cameras ensured abusive employees could continue with their misconduct without the fear of being caught. Saline County attorney Parker Stinar also stated that the Arkansas Office of Long-Term Care was aware of the allegations but failed to investigate the concerns of the vulnerable individuals.

What Damages Can Victims Recover?

Victims who have been sexually abused in these environments could recover compensation with Arkansas sexual assault lawsuits. However, winning a claim comes with significant challenges, which is why working with expert attorneys is essential. Our lawyers will assess all damages to maximize your potential settlement.

Some of the most common legal damages in sexual abuse claims include:

Economic Damages

These losses are associated with specific amounts, making it more straightforward to calculate them for a potential payout. Economic damages may include:

  • Lost income – If injuries force you to miss work, you can recover lost wages
  • Lost earning capacity – Sexual abuse can have a devastating impact on your physical and emotional health, which may affect your ability to find employment
  • Medical expenses – If you receive medical treatment for physical or psychological damage, such as emergency care, medication, or therapy, these costs could be covered by the settlement

Non-Economic Damages

This type of loss is a little more flexible. Non-economic losses can significantly increase the value of a lawsuit. Here are a few non-economic damages that may be included in your claim:

  • Emotional distress – If you suffer psychological harm because of the abuse, such as anxiety, depression, or PTSD, medical evidence could increase your payout
  • Pain and suffering – A particularly violent assault may leave you with injuries that cause significant physical pain
  • Loss of enjoyment of life – Many sex abuse victims fail to obtain the level of joy they used to in normal life activities, leading to a diminished quality of life

Punitive Damages

When staff members commit sexually abusive behavior against patients, it may constitute gross negligence, intentional misconduct, or institutional cover-ups.

In such cases, a judge may impose punitive damages against the defendant to ensure they are severely punished. These damages will also increase the plaintiff’s payout.

Several state laws may have a significant impact on the outcome of your lawsuit. Our attorneys will help you leverage the following statutes to your advantage:

  • Ark. Code Ann. § 5-1-109(h) – There is no statute of limitations for pressing criminal charges after the rape or sexual assault of a minor. This means you do not have a deadline to worry about, even if the assault occurred decades ago.
  • Ark. Code Ann. § 16-56-130 – For a civil lawsuit, survivors of child sex abuse who are pursuing claims as adults must pursue legal action within three years of discovering the abuse. Although new legislation had been introduced in 2023 to extend the age limit to 55 years old, it was reversed.
