Dr. Derrick Todd Sexual Abuse Allegations

Jonathan Rosenfeld

Sexually Abused Survivors Might Be Entitled to Compensation

The recent Dr. Derrick Todd sexual abuse allegations have raised serious concerns across Massachusetts, especially for those who trusted him with their care.

Derrick Todd, a former rheumatologist, has been accused by former patients of performing invasive and unnecessary exams under the guise of medical treatment while practicing at Brigham and Women’s Hospital and Charles River Medical Associates in Framingham.

When doctors cross professional boundaries, patients are left with deep emotional wounds and questions about their rights. Our role is to help victims seek justice by filing a sexual abuse lawsuit in civil court to pursue financial recovery for therapy, medical costs, and emotional suffering.

If you or a loved one were a patient of Dr. Todd, we are here to guide you through the legal process and fight for the compensation you deserve.

Latest Updates

Former rheumatologist Todd practiced medicine in Massachusetts and was affiliated with major institutions such as Brigham and Women’s Faulkner Hospital and Charles River Medical Associates.

Over the past year, disturbing reports have surfaced from former patients who allege that Dr. Todd crossed professional boundaries and engaged in misconduct disguised as medical care.

The Dr. Derrick Todd sexual assault allegations are part of a larger pattern seen in other gynecologist sexual abuse lawsuits, where medical authority was used to exploit patients’ trust.

For victims of sexual assault, the legal system provides two critical avenues: criminal prosecution to hold the doctor accountable, and civil actions to secure financial compensation for the immense harm caused.

Grand Jury Indictment

In January 2025, a Middlesex County grand jury formally indicted Dr. Todd on two counts of rape, based on alleged assaults during medical exams in December 2022 and June 2023 in the aforementioned hospitals in Boston.

He surrendered to authorities, pleaded not guilty at arraignment, received a $10,000 bail, and was ordered to surrender his passport and medical licenses, refrain from contacting survivors, and not practice medicine.

Former Patients of Dr. Todd Claim He Performed Unnecessary Exams

Dr. Todd is alleged to have performed medically unwarranted pelvic, breast, and rectal exams—often prolonged and without a chaperone—on both female and male patients under the guise of “treatment” for rheumatological conditions.

In April 2023, two physicians at Brigham and Women’s Faulkner Hospital came forward and raised concerns about his behavior. The facility launched an internal investigation and placed Dr. Todd on administrative leave.

In July 2023, the hospital terminated Dr. Todd’s employment following their sexual assault investigation.

By September 2023, Dr. Todd voluntarily entered an agreement with the Massachusetts Board of Registration in Medicine, surrendering his medical license, and stopped practicing medicine in the state.

Class Action Lawsuit Against Brigham and Women’s Hospital and Other Facilities

The first civil lawsuit, including what later grew into a class action lawsuit, was filed in Suffolk Superior Court on October 11, 2023, naming Dr. Todd, Brigham and Women’s Hospital, and Charles River Medical Associates in Framingham as defendants.

By April 2024, over 200 women and several men publicly accused Dr. Todd of sexual abuse and unnecessary medical exams. These claims were consolidated into major class action litigation.

What Damages Can Victims of Sexual Assault Recover in Civil Lawsuits?

When a victim files a sexual assault lawsuit, the purpose is not only to hold a perpetrator like Dr. Todd accountable but also to provide meaningful financial recovery for the harm endured.

At Injury Lawyer Team, we work to ensure that every form of loss—both financial and emotional—is addressed through the civil system.

Economic Damages

Economic damages cover measurable financial losses tied to the abuse, including:

  • Medical expenses: Costs for follow-up treatment, corrective care, and any additional exams required to address physical harm.
  • Mental health treatment: Counseling, trauma therapy, and psychiatric care are often essential for recovery after abuse.
  • Lost wages and reduced earning capacity: Survivors of sexual assault who miss work or suffer long-term impacts to their careers because of the trauma may recover compensation for those losses.

These damages aim to ease the financial burden so survivors can focus on healing without the stress of mounting bills.

Non-Economic Damages

Not all injuries of sexual abuse can be calculated on a balance sheet. Non-economic damages are often the most significant part of a civil recovery in sexual abuse cases:

  • Emotional distress and psychological trauma: Anxiety, depression, PTSD, and fear of medical professionals are common consequences.
  • Humiliation and loss of dignity: Sexually abused victims often carry deep emotional scars from invasive and unnecessary exams disguised as care.
  • Pain and suffering: Courts recognize the profound personal toll of being exploited by a trusted doctor.

Punitive Damages in Abuse Lawsuits

Courts may sometimes grant punitive damages to penalize severe misconduct and discourage similar acts of sexual abuse.

Given the scope of the Dr. Derrick Todd sexual assault allegations at Brigham and Women’s, a strong argument can be made that punitive damages are necessary to send a message to both individual physicians and the institutions that enabled them.

What Laws Govern Sexual Abuse Lawsuits Against Dr. Derrick Todd?

Survivors of Dr. Derrick Todd have two major paths for justice: the criminal system and the civil system. Each relies on a set of Massachusetts laws designed to punish wrongdoers and provide compensation to survivors.

At Injury Lawyer Team, we use every available statute and legal precedent to build the strongest possible case.

Criminal proceedings against Dr. Todd focus on holding him personally accountable for his actions as a physician.

Key statutes include:

  • Mass. Gen. Laws ch. 265, § 22 — Defines and criminalizes rape. Prosecutors have charged Dr. Todd with two counts of rape, based on allegations of sexual penetration during medical exams without consent.
  • Mass. Gen. Laws ch. 265, § 13B — Governs indecent assault and battery, covering unwanted touching of intimate parts. Survivors who describe pelvic, breast, rectal, and testicular exams without medical necessity may fall under this statute.

While the criminal system punishes offenders, the civil system is where survivors seek financial damages and accountability from both the perpetrator and the institutions that enabled him.

In Doe v. Trustees of Boston College (2019) Massachusetts courts have recognized that institutions can be held liable for ignoring or mishandling misconduct complaints. In Dr. Todd’s case, plaintiffs argue that the hospitals had a duty to intervene much sooner.

One of the most critical issues in any sexual assault lawsuit is the civil statute of limitations for sexual assault cases, the legal deadline for filing a case. Massachusetts has expanded its laws in recent years to give survivors more time, especially those sexually abused as children.

Adult survivors generally have 3 years from the date of the assault to file a lawsuit in civil court. The discovery rule may extend this period if the survivor only later realizes that their psychological harm—such as PTSD, depression, or anxiety—was caused by the abuse.

Massachusetts law (Mass. Gen. Laws ch. 260, § 4C) is far more protective for those abused as children. Survivors can file a civil claim up to 35 years after the abuse occurred, or within 7 years of discovering the harm was caused by the abuse, whichever gives more time.

Because the statute is “tolled” until adulthood, the filing period does not begin until the survivor turns 18. In practice, this means survivors have until at least age 53 to pursue legal action.

How Injury Lawyer Team Can Help

At Injury Lawyer Team, we understand how overwhelming it can feel to come forward against a trusted physician. Our role is to protect survivors by filing sexual abuse lawsuits, guide them through the legal process, and pursue the justice they deserve.

Allegations against Dr. Derrick Todd involve both individual misconduct and systemic failures by institutions that failed to act. We are uniquely positioned to hold both accountable.

While prosecutors pursue criminal charges like rape and indecent assault, our team focuses on the civil side. As experienced doctor sexual abuse lawyers, we file lawsuits in civil court to seek compensation for therapy, medical costs, lost income, and the emotional toll of abuse.

By coordinating with prosecutors, we strengthen your case and ensure that survivors’ rights are protected on every front.

We know privacy is a top concern. Wherever permitted, we file under seal to protect our clients’ identities. This ensures survivors can pursue justice without fear of exposure. Many of our clients take comfort knowing that their names can remain confidential while holding institutions and abusers accountable.

Our firm investigates not only Derrick Todd but also the hospitals that employed him. We issue subpoenas for internal complaint logs, prior disciplinary records, and credentialing files.

These documents often reveal whether administrators at Brigham and Women’s Hospital in Boston or Charles River Medical Associates ignored sexual abuse warning signs. In past sexual assault lawsuits, such evidence has proven critical in showing a pattern of negligence.

As seasoned doctor sexual abuse attorneys, we fight for every dollar our clients are entitled to under Massachusetts law. That means pursuing both economic damages (medical bills, therapy, lost wages) and non-economic damages (pain, suffering, and emotional trauma).

Where justified, we also pursue punitive damages to punish egregious misconduct and drive systemic change within hospitals.
